Issues and Dilemmas of Public Guardianship System Process for Persons with Developmental Disabilities

Abstract
The purpose of this study is to explore the experience of supported decision-making of adult guardians when providing ¡°public services of adult guardianship for persons with developmental disabilities" and examine related issues. We conducted a focus group interview with public guardians who were recommended by the guardian organization and discussed related issues. First, regarding the quality of public guardianship services, the guardians identified limited guardianship time and guardianship tasks requiring expertise as concerns. Second, the issue of whether it is best to guarantee the right of self-determination for persons with developmental disabilities in guardianship activities was raised. Discussion on this included: a limited understanding of the situation due to communication difficulties; conflict between stakeholders, and conflicts regarding self-determination; and meeting best interests based on ambiguous decision-making standards. Third, the boundary of the guardianship activities is unclear, raising issues that defined its scope as too wide or narrow. It was difficult to establish boundaries for guardian activities due to guardian tasks being difficult to standardize, which sometimes leads to problems in which guardian activities are limited only to property management. In this process, the guardians experienced physical and emotional exhaustion. Fourth, issues were raised about whether there were opportunities to improve the decision-making ability of people with developmental disabilities in the Public Guardianship System. Finally, the issue of linkage between disability-related organizations and limitations of cooperation were raised, and the need for an effective guardianship supervision system was discussed. On the basis of the above findings, this study suggests policy proposals to stabilize the Public Guardianship System as a supported decision-making and rights advocacy system.
